These General Terms and Conditions (“Terms”) govern the use of the website cablane.ch (the “Website”) and the services offered by CABLANE Swiss, POB 427, 4002 Basel, Switzerland (“we”, “us”, or “Cablane”). By accessing our Website or booking our services, you agree to be bound by these Terms. If you do not agree, please refrain from using the Website or our services.
1. Scope of Services
Cablane provides premium chauffeur services, personal butler services, and exclusive event access arrangements across Switzerland. Our services include, but are not limited to:
- Private chauffeur services with luxury and all-electric vehicles
- Airport transfers and long-distance travel
- Personal butler and concierge services for private clients, diplomats, and corporate guests
- Arrangement of access to exclusive events, galas, and cultural occasions
The specific scope, schedule, and pricing of each engagement are confirmed individually upon booking. Promotional content on the Website does not constitute a binding offer; it is an invitation to submit a booking request.
2. Booking and Contract Formation
Bookings may be made via the contact form on the Website, by email at contact@cablane.ch, by phone, or via WhatsApp. A binding contract is formed only upon our written confirmation of your booking (by email or message).
We reserve the right to decline any booking request at our sole discretion without providing reasons. By submitting a booking request, you confirm that the information you provide is accurate and complete.
3. Pricing and Payment
All prices are quoted in Swiss Francs (CHF) unless otherwise stated. Prices communicated during the booking process are binding upon our written confirmation. Unless agreed otherwise, value-added tax (VAT) is included where applicable.
Payment terms are specified in the booking confirmation. We may require advance payment or a deposit for certain services. Accepted payment methods will be communicated at the time of booking.
In the event of late payment, we reserve the right to charge default interest at the statutory rate under Swiss law (Art. 104 CO) and to suspend services until outstanding amounts are settled.
4. Cancellation and Modifications
Cancellations and modifications must be communicated in writing (by email or message). The following cancellation terms apply unless otherwise agreed in your booking confirmation:
- More than 48 hours before the scheduled service: full refund of any advance payment, minus a CHF 50 administrative fee.
- 24 to 48 hours before the scheduled service: 50% of the agreed price will be charged.
- Less than 24 hours before the scheduled service: 100% of the agreed price will be charged.
- No-show: the full agreed price will be charged.
We reserve the right to cancel a booking due to force majeure, severe weather conditions, or other circumstances beyond our reasonable control. In such cases, we will offer a full refund or an alternative arrangement.
5. Client Obligations
By using our services, you agree to:
- Provide accurate and complete booking information, including pickup locations and timings.
- Treat our chauffeurs, butlers, and staff with courtesy and respect.
- Refrain from any conduct that could endanger the safety of the driver, passengers, or the vehicle.
- Be liable for any damage to vehicles or property caused by you or your guests during the service.
- Comply with Swiss law and applicable regulations at all times during the service.
6. Liability
We shall exercise due care in the provision of all services. However, our liability is limited as follows:
- We are liable for damages caused by intentional misconduct or gross negligence on our part.
- In cases of ordinary negligence, our liability is limited to foreseeable, direct damages and shall not exceed the total fee paid for the specific service in question.
- We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits, missed flights, or missed events, to the extent permitted by Swiss law.
- We are not liable for delays or failure to perform caused by force majeure, traffic conditions, road closures, weather events, or other circumstances beyond our reasonable control.
Any claims must be submitted in writing within 30 days of the incident giving rise to the claim.
7. Intellectual Property
All content on the Website — including text, images, graphics, logos, design elements, and the “Cablane” brand — is the intellectual property of CABLANE Swiss or its licensors and is protected by Swiss and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.
8. Website Use and Availability
We make reasonable efforts to ensure the Website is available and its content is accurate. However, we do not guarantee uninterrupted access or that the Website will be free from errors or security vulnerabilities. We reserve the right to modify, suspend, or discontinue any part of the Website at any time without notice.
9. Data Protection
The collection and processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms.
10. Amendments
We reserve the right to amend these Terms at any time. Changes will be published on this page with an updated date. For existing bookings, the Terms in effect at the time of booking confirmation shall apply. Continued use of the Website after changes are published constitutes acceptance of the revised Terms.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of laws provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for any disputes arising out of or in connection with these Terms is Basel, Switzerland. Mandatory statutory provisions regarding jurisdiction for consumers remain unaffected.
